Should accused 'citizen terrorists' lose their rights as citizens?

(CNN) – A new bill is going after the citizenship of accused terrorists. It would allow the State Department to take it away from people like the suspected Times Square bomber and others who try to attack the United States.

A bipartisan group of legislators on Thursday introduced the legislation in Congress to strip citizenship from any American found to be involved in terrorism.

If the Terrorist Expatriation Act passes, an American would lose citizenship if found to have provided material support or resources to a foreign terrorist organization - as designated by the secretary of state - or participated in actions against the United States.

Sens. Joe Lieberman, I-Connecticut, and Scott Brown, R-Massachusetts, co-sponsored the bill. An identical bill is being introduced in the House by Reps. Jason Altmire, D-Pennsylvania, and Charlie Dent, R-Pennsylvania.

The sponsors of the bill say it's a tool we need to fight a new war. Our Jim Acosta has the report this morning.

    The due process granted under the 6th Amendment to the constitution can find a citizen guilty and therefore strip his Citizenship. But he is entitled to his day in court.

    John Doe and Maurice I may not like what you say. But I will defend (To my Death) your right to say it. The same goes for a Citizen's right to a fair and speedy public trial, to notice of accusations, to confront the accuser, to subpoenas, to counsel.

    Melon, I am against the AZ law because it will infringe on the rights of American citizens, especially those of Hispanic descent! I never stated illegals had a right to enter the US. Again, you read what you want to reads, not what is being said!

    What I stated about Miranda warnings is a fact, not an opinion. You really need to research topics before commenting on them! Learn the facts before giving your "opinion"!!!!

    If the US is at war with terrorism then the Geneva Convention applies to the terrorists. They would POWs not 'enemy combatants". I feel everyone has rights...globally. When you start to remove people's rights, for any reason, we all lose something. Our Humanity. Pay for their crimes..certainly. But we dont want to lose our humanity in the process.

    Everyone believes in the constitution! Yet there are those who would strike it down to advance their political aspirations? is this a traitor?

    Everyone hates the terrorists'! but the opposition wants to safe guard their protection.

    Soldiers are dying in the war against terror! Yet Americans are arguing for the rights for terrorists' in America? Would someone please un-confuse me?

    The US is spending billions each year to kill terrorists! and some wants to spend another few billions to protect them? Wow! Do I need a MBA/PhD/MAD to understand the logic?

    John..flooding in Nashville...with increasing weather woes this becomes a normal action for Nashville and many other areas. Another Katrina more powerful than the first is scheduled as well. And that is just dealing with one national child in a global schoolyard....much to do and much more to come real time real time.....this all relatively minor even if it is seen as serious...other national children top deal with here as well
    with each going through their own turmoil...

    Someone said, ax muderers still are citizens. This is true, but the NYC bomber was a Naturalized citizen, meaning by the constitution his rights have to be revoked.

    The TEA Act is another knee jerk political response – Revocation of a person's US citizenship should (and can, under law) be applied in those cases where a person renounces their citizenship or it can be established that that person gained their US citizenship by deceptive means. This could be as simple as willfully omitting information on the petition for citizenship. As for the others, there's always the statute covering high treason. Unfortunately, Federal Prosecutors have an awful track record when prosecuting high treason cases.

    If American Moms new the truth about the manufacturing of fireworks these gun powder creations would be band for sales in the USA!

    The blindness in children along with the amputations and deaths caused among children laborers is a human tragedy.

    I saw a documentry on PBS a few years back and one little girl around 12 years old worked and stayed home making fireworks and all her hope and happiness were tied up in her little sister being able to go to school because of her working.

    By denying people accused of terrorism in or against the US your country is drifting further from what was intended by your forefathers.
    I have no sympathy for terrorists however, the denial of basic rights to these people is not an American question; it is a human question.

    I think anyone who tries to destroy this country either naturalized citizens or a someone born here should lose thier citizenship. If you preach on a corner of destruction of this country. Immigrants should be sent back to thier country of orgin and citizens should be sent to the country the are loyal to. We are supposed be be a place to come and assimilate into this country meaning learning our language, living in harmony with everyone and try for a better life. If someone in this country wants to hurts us and is open about or gets caught, I think it should be considered treason. Thanks

    To those who oppose the thought of stripping citizenship of terrorists', i have one question for you! Would you allow a rapist to sleep in the same bed with your children? We all know the answer to that!

    Same reasoning here, do you think a hard working, decent American should have a terrorist living next to them? I think not!

    Americans should consider the ramifications of inviting terrorists' to becoming US citizens seriously! remember, they could be living in your neighbourhood! Right next door to you, with a black 4runner parked in front of your house!

    I can't believe the comments im reading in support of this man. No doubt he should be stripped of his citizenship and it shouldn't even be up for debate. People keep refering to Timothy McVeigh, understand that we live in a different time now. We are underseige by a different terrorism, that we've allowed to infiltrate our country with our lax LAWS and lax ATTITUDES about security. America needs to wake up and stop acting like everday is a vacation!!!!!

    Of course this argument on citizenship will be politicalized and played for as much brownie points as can be had! However, i'll bet those who oppose the bill to strip citizenship from Known terrorist or affiliates will lobby their incumbent to not have them live in their community!

    When Mr.Shazad took the oath of allegiance the the USA, i can just imagine the smurk he had under his breath, just thinking of how many would die in the explosion! The sad thing is, there are many good, decent people who would die for the opportunity to relocate to the USA but, economically they can't afford it or don't have the help to do it,

    I got my citizenship and I am from the Middle- east but when I came here it was my choice to be American. Politics in this country need to man up and protect this country not protect their seats. If anyone try to hurt this country, he/ she is not an American, and do not deserve to be American.
    Jesus said, you can’t serve two masters how you can be loyal to two countries which country you will support against the other. At the end it is your choice to be American or not if you became a terrorist so you gave up that choice and you deserve to charge with treason.

    A drunk driver kills an American Citizen every 15 minutes in this country. I would consider that terrorism. Yet, one terrorist tries to blow up an SUV, and we are ready to challenge our citizenship laws. These terrorists sure know how to get things done in Washington.

    If you strip someone of their citizenship prior to conviction, they can't be tried for treason! Treason is defined as taking up arms against the govt. The Times Square bomber tried to blow up civilians, not the White House or Congress. This is why he's not charged w/ treason!

    The question is whether the citizenship of home grown terrorist should be revoked, but this is so off the point! Even ax murderers who are tried, convicted, and executed are still citizens! The real point has to to with reforming the laws of treason to deal with home grown terrorists.

    I can see it now, the Arizona police asking anyone they don't like the looks of for their papers and locking them up if they can't produce them. And then even if you can produce your papers they declare you a terrorist, take away your citizenship and lock you up anyway. It sounds like Nazi Germany.

    From a true American citizen with a real US birth certificate or is it fake? No one will be save!

    It becomes increasingly questionable whether many Americans hold true to any values whatsoever. Practicality aside, making citizenship expendable makes it a convenience not a value.

    It is really scary to think how successful Osama Bin Laden has been in turning the USA into a pale shadow of itself and more like his own.

    If you can lose your citizenship just by being accused, then anyone can accuse a Presidential Candidate, to get rid of him or her. How long did those on the Right, the Wing-nuts, and those in the Tea Party say that President Obama was a Muslim? If this country does that there will never ever be a revolution in this country, because all the government would have to do is say that you are a terrorist then you lose all of you rights, and you can be imprisoned for as long as they want to imprison you! America is becoming a police State, cowardly, unwilling to look for the true, because fear and hate works so well at push the people to go along with what the government wants to do to the people of America and other nation States!

    Only a coward would want this to pass, I did not serve in the Military for this to happen to my country!!!

    Marissa, i believe it does matter whether one is a born citizen vs. naturalized! One that is born cannot have his./her citizen revoked, however, one that is naturalized, has asked the government of the US and it's people to accept them into their society because they love the American way! When they LIE and come with the intentions to kill those who embrace them, then they have betrayed the very fabric on which a country is built!

    Why do we continue to protect people that do harm to us? Be it terrorists, pedophiles, rapists, murderers. When people commit these horrific acts and are found guilty, they should lose all of their rights.
    If this man is found guilty of this cowardly act that was committed in New York then his citizenship must be revoked and he must be returned to wherever he came from.

    What exactly must they do that makes it a terrorist act? It could be extortion, blackmail, a distraction for a criminal act, or the act of someone who is legally insane.

    Why debate the 14th Amendment? I served this Country for 22 years in the U.S. Army to secure ALL the rights of the Constitution and ever since George W. Bush became President Congress is daily trying to subvert the rights of the citizens of this great country and I for one am tired of it.

    The main clauses of the Fourteenth Amendment are:

    Section. 1. All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.
    ...

    Section. 5. The Congress shall have power to enforce, by appropriate legislation, the provisions of this article.

    No, I do not think that the accusation of terrorism should be an automatic lose of citizenship. They must be allowed due process and if convicted of terrorism...then yes...they lose their citizenship. However, even then does it really matter? Hopefully they will be locked away forever. Bad idea of stripping someone’s citizenship just solely on the accusation of terrorism. Innocent until proven guilty.

    I agree with the concept of losing naturalization/citizenship once proven ties with terrorists. One must remember that citizenship is a priviledge not a right! And like any other privilidge, it should be preservered, revered and respected! Would you allow a convicted murderer to live in your home with your children? I ask this of those who believe a proven terrorist should enjoy the same right as another Hard working, loyal American or Canadian for that matter.

In fact, in border states like TX & AZ, they include the sentence that they have the right to contact their consulate prior to questioning.

    This is just another example of worthless politicians talking tough for the next election. We have 12 million illegals who broke the law coming here illegaly selling drugs, joining street gangs, taking jobs away from u.s. citizens and some even think that the u.s. is still part of mexico but politicians are tripping over themselves to prevent anyone from violating their so called rights by asking for ID. General lee and jeff davis the president of the confederacy never lost their citizenship or spent a day in jail for declaring war against the union and killing thousands of fellow citizens. If you are a legal citizen and accused of a crime in the u.s. you have certain rights, and they can't be taken away because you tried to light your car on fire. What does it matter anyway if the acccused terrorist is found guilty he will be in jail for life, citizen or not.

    Would we have stripped Tim McVey of his citizenship or any of his rights under the law? Whether someone is born here or naturalized shouldn't matter. How about the teens at Columbine? Does the reason they killed matter? What's the difference between the terrorist bomb that kills one person and the serial killer who kills ten? Isn't a mass murderer a mass murderer regardless of whether he does it one at a time or all at once? Or – as I suspect – does it really come down to the religion of the person doing the killing?

    Yes, they should be stripped of their citizenship. The oath taken when becoming a citizen is to defend this nation. These terrorist have only one thing in mind...hurt this country and the people in it.

    Laws are laws. However, an exception must be made!! and this must be the one, otherwise, these terrorist will continue test the system.

    America debates whether to strip the citizenship of terrorists but give a hard time to those poor illegal mexicans who work for years in the fields who want to better themselves and who will do whatever it takes to protect this country.

The terrorists will definitely have won the terror war when that happens – they will have effectively destroyed our democracy. The foundation of the United States is the ideals and freedoms generations fought to secure and protect.     I didn't know the US government is going to base citizenship and its denial based on what people will become rather than on who they are. Sounds a bit ridiculous to me. Will INS officials use government mandated 'crystal balls' to predict 'terrorist propensities'? It flies in the face of common sense and basic human rights to believe that such 'form profiling' will solve US terrorist woes. Unbelievable! Yet I must admit, it is both desperate and innovative.

    Would the revocation of citizenship apply to all engaging in "terrorist" activities or just those who've been naturalized or who look different? There are expanding numbers of militia arming themselves against the government with rights protected by the Bill of Rights and the NRA in our country. One, Timothy McVeigh, succeeded in pulling off a terrorist attack. At what point are their activities "terrorist" in nature? Should their citizenship be at risk? from Georgia

    We are at a time right now where we should think about the nation and its citizens. The system is outdated and I do believe that it should be provision in the application process that if someone takes arms against the public, or against our country for any reason that person should be stripped of his/her citizenship. It is like having a membership in any organization if for a reason or another you stop believing in the organization, you remove yourself from that organization or you get disbanded. Why be part of a country or of an organization if you never believe in that organization or if you stop believing in it. It is time that
    the U.S. starts protecting itself and starts caring more about the country and its citizens who live inside the country and not those who keep damaging the country.

    With the right to due process and the presumption of innocent until proven guilty at a trial of your peers, how can a presummed terrorist be stripped of these rights? If it could happen, it would have to be after a trial where he was found guilty, thus becoming a moot point.

    Nobody wants to help terrorists but if this bill passes we set ourselves up for a slippery slope. Where does it end? Do accused people in a murder investigation no longer deserve Miranda right in the future? Shoplifters? Speeders? Where would the line be? Citizens rights must be protected.

    If the government is allowed to strip an American citizen of his/her rights than the person never had rights to begin with as those rights were designed to protect the individual from the governments persecution. Its like telling us we can do whatever we want (freedom) as long as THEY say its ok(no freedom). Makes NO sense. How about we just fix the problem that leads people to dislike the government.

I believe that once a person is convicted of a crime against America such as this one with the attempted car bombing in NYC, then and only then should this person be stripped of his/her citizenship. At this point in the game it has been proven and shows that this person is not worthy of living under our protection if he/she is willing to cause us harm. He/she is on his/her own after this point. It was a choice they made for themselves and they should live with the choices they make.

    There is no need for a new law stripping American terrorist of their citizenship. Just put them on trial for "treason" and then apply the consequence of the death penalty when they are found guilty. Stop playing politics and deal with the issue with our current laws.

    The Oklahoma bomber was a home grown terrorists and a citizen...was his citizenship taken from him during his trial? A citizen is a citizen and due the rights included by being a citizen of that particular nation with the United States the nation in question. A citizen on trail for treason. Deal with that.

    I think the would be terrorists should be stripped of their citizenship. Even more so, I think racists should be stripped of all their civil rights. Why not get to the root of hate and terrorism. Racists are at the helm of world social problems but no one tends to point that out. I wonder why?

    The USA is prooving to be no better than the USSR or Hitler or (Insert name of dictator here).

    The fundamentals of this matter are not about Citizenship, they are about protections according to law. Protections such as fair trial, not a "banana republic" show trial with summary execution.

    There is a militarist clique in Washington, from Senators to Military officials, that itch for war and torture and to swager around looking masculine.
    The clique seems as though they want show trials and summary executions. If they don't then let them show support for having every trial of anyone suspected of terrorism in civilian courts where everyone in the nation can know the contents of every minute of court proceedings.

    For the time being they have a receptive audience willing to accept and support the idea of stripping Muslims of the protections afforded us in both American law and International law. Such people are vehemently anit-muslim and often espouse the Zionist agenda.

    Woe be unto such people the day that what they want done to us turns on them. How shall it turn on them?

    One needs only to look to the example of Greece and the rioting occuring there to see how what they want done unto us shall turn on them. When the American public is forced into "austerity measures" which rob them of what they have saved and what they are to earn, then watch as they march into the streets to be greeted by soldiers with guns pointing at them. Then, that day, those that march shall be labelled "Domestic terrorists." How then that day shall they feel about removing the protections afforded them according to law?

    Oil rig....5000 barrels a day= over 900, 000 liters or 250,000 gallons each day for the past two weeks being pumped openly into the waters will have a long term ecological affect that will span decades will it not. How does BP compensate the People and States involved on that level?

    The Miranda warning isn't a right limited to citizens. It applies to anyone detained/arrested in this country! I wish people, especially lawmakers, would study the Constitution instead of stating what they want it to say! Everyone in this country is entitled to due process & no American citizen should be subjected to loss of citizenship on suspicion!

    taking away the rights of a citizen for any reason is unconstitutional. i am very skeptical of this new bill. it seems to me that it could be misused in the same way the Patriot Act is being misused now. When do you take their rights? before or after the trial? it would be a tragedy in this country if we were to strip people of their rights, as Americans and as human beings, before they had a trial. history has a way of repeating itself and this sounds an awful lot like the Salem witch trials or Neo-McCarthyism

    Most of the rights in question,e.g., Miranda Rights, are not the result of citizenship but of being a person in our jurisdiction. US citizenship is not the same as Roman citizenship might have been. Some of the comments made by Wolf Blitzer, Frank Lautenberg, Lieberman, etc., show that they should read the constitution more carefully.

    Once one becomes a citizen of this country, then they are entitled to all the protections that go along with it. He will have to face due process just like any other American. No one said that Timothy McVeigh shouldn't of had his due process.
