(CNN) – A federal judge in Arizona will hear arguments today in two lawsuits challenging the state's controversial new law targeting illegal immigrants, including one brought by the Obama Justice Department. Arizona's law is set to take effect next week and supporters say it's a response to the federal government's failure to secure the southern borders. The feds say the borders are more secure than ever. Could both sides be right? Our Casey Wiann takes a look. Watch ![]()
The Obama administration's challenge to the controversial Arizona immigration law goes before a federal judge Thursday.
The Justice Department's lawsuit, seeking to stop the law from going into effect, is one of two challenges scheduled for a hearing Thursday.
The first challenge by a group of more than 100 individuals and civil rights groups will be heard Thursday morning. In the afternoon, the Justice Department's lawsuit will have a hearing in a Phoenix federal courtroom.
Both cases will be in front of U.S. District Judge Susan Bolton, according to court documents.
The law, signed by Arizona Gov. Jan Brewer in April, requires police to question people about their status if they have been detained for another reason and if there's reason to suspect they're in the United States illegally. It also targets those who hire illegal immigrant laborers or knowingly transport them.
Critics have said the law will promote racial profiling. Supporters of the bill say its aim is only to enforce federal law.
The law is scheduled to go into effect July 29.
It is unclear how Bolton will rule on the cases. She heard another legal challenge to the law last week, which was brought by an Arizona police officer.
She did not make a ruling in that case.
The lawsuits are among seven that have been filed against the law.

The jobs these illegal immigrants talk about filling that others won't do is a horrible misconception. The truth is that they are filling a LOT of jobs Americans could be doing.
There was a video of an illegal leaving AZ to NM, he'd held a position as a mechanic. Others work in places like Taco Bell and McDonald's and those are jobs our teens should be filling.
The whole system is failing the American people and it's our youth that really suffer most. While the children of illegals have been taught English (ESL classes), our youth was not taught to speak Spanish.
Equal should equate an equal education for all people not just the illegal immigrants. I think we've been generous long enough and it's time they applied the skills they've learned here in their own country.

The simpliest and cost effective way to stop businesses from hiring illegal immigrants
is to let them pay for all deportation charges for each illegal found in their employement.
This will encourage businesses to hire only documented workers using E-Verify.

Try going to Mexico without a passport or staying there without papers. Obama criticizes the Cambridge police for not getting the facts right yet the officer brought Gates to the police station to do just that. Gates had a drivers license and Id from another state. He was renting that house.
So now Obama wants to sue Arizona for checking identity. We have a huge identity theft problem in this country and an Alderman from Chicago was recently convicted for creating and selling false ID's.
Obama's Social Security number is from Connecticut, yet he never lived there. How could he use an address in Hawaii and obtain a Connecticut address. This person maybe an illegal immigrant and is pushing to change the law so he is legal. He wants Immigration reform as do all of the other illegal immigrants. Why would an illegal immigrant or President with a suspicious SS number want there status checked out?

Farmers have the ability to request x amount of farm workers through the guest worker program, but they would rather have cheaper labor. California should be sued as its majority is illegal and that's why they are broker, due to paying for medical, educational, and welfare benefits to illegals. Nothing is being done to really secure the border because the Government doesn't want to, and wants trade with Central America, Mexico, etc., so they don't want to upset the applecart by deporting illegals and this government resents Arizona for SB1070. The AZ. law is the best thing for America and many states are going to enact the same law. We can't afford welfare for our own citizens, and don't need or want Mexico's illiteracy and poverty!

The American dream is still alive, you just need to follow the rules. What did the people who are here illegally expect? They act like they are being discriminated against. My Korean Aunt became a citizen of the US in the 50's. I remember how proud she was to become a citizen. She and her children who came from Korea all changed their names to "American" names because they couldn't think of anything better than being American. The first priority for them was to learn to speak english, dress like Americans.
I have a married couple from El Salvidor who have worked for me for 19 years, I can't tell you how much time and money we spent for them to become US Citizens. But it was worth every penny. They came here with work permits and temporary visas. They didn't run across the border expecting to "hide out" the rest of their lives in the US.
This situation is like life. When things are good and money is flowing everyone overlooks what is going on. When the economy is bad, look out, everyone is looking for cuts.
Nonenforcement marginalizes the often well meaning illeagals. They are scared to report crimes against them, exploited by employers, and often turn to illicit activities for upward mobility since they can't pursue success through more legitimate avenues. Counterintuitively, it is a lack of immigration enforcement that creates second class citizens and locks them into poverty. These problems can't exist with a secure border and enforcement of immigration laws.
AZEIR are a bunch of chicken hawks who don't want imm. ref., but rather a continuation of nonenforcement. The second another round of amnesty is granted, they will still hire illegals to avoid taxes and minimum wages.
Everyone would be happy if:
1. The state dept. overhauled its handling of immigration throughout the world. (anyone who's seen the way our embassies treat those seeking enrtry knows what I'm on about.)
2. A guest worker program was initiated.
3. Borders and immigration laws were enforced.
I live in Arizona, and I am sick to death of all the news coverage dedicated to these protests and boycotts. This only fuels this ridiculous behavior. Upholding the law is not racist, no matter how hard the protesteers and media try to spin it. I'm speechless over how these protestors actually believe that illegals should be protected. And as for this guy with his "family" business – I'm sure he abused the system by taking (stealing) tax benefits that he was not entitled to because his wife was not legal – It wasn't a corporation as his wife was illegal – so he was filing all those years as a "sole proprieter" with income gained and tax benefits allowed. Now that we have video evidence I would hope the IRS would go after him and collect any tax breaks which he obtained illegally.

Why does the media constantly cry crocodile tears for people who reside here illegally. They talk about breaking up families, because the illegals have to go home and the kids have to stay here with out parents. I don't get it. If I was in Mexico illegally and they sent me home no one would care.

Illegal immigration is a cancer that infests every corner of this nation. Arizona is a leader in getting this done and Obama, as usual, is much of the same ol. I hope IN follows Arizona and creates a similar law. We have already begun requiring ID's to buy alcohol no matter the age, US issued id only. That could change things.
I have no problems with aliens being in this country and working at any job they they are qualified to handle. However, we need to know who they are, where they are, and what they are doing. This is a matter of national security.
Just as you wound not want someone camping out in your bedroom and raiding your fridge without your knowledge, nor can we afford undocumented aliens in this country. They need to ring the doorbell rather than crawling in through the back window.
The solution to the illegal alien problem is simple. Eliminate the reasons why they are coming here ... jobs and welfare. The easiest way to eliminate the jobs is to place a bounty of the employers that hire illegals. Any citizen or legal alien who turns in an employer illegals would be entitled to half of any fine collected, tax free.
We would have to be careful how this is implemented as it could get out of hand. However, it is not without precedence in this country. Citizens who turn in tax cheats are entitled to a portion of the fine collected.
Undocumented aliens should denied ALL government benefits. This would include housing, food, or financial assistance of any kind.
These two steps would work in conjunction to discourage illegal aliens from entering the country and the ones already here to leave. Employers would think twice about hiring illegals because everyone would be out for the bounty. The lack of government aid would make it difficult to stay.
In this way we would not have to build ineffective border fences and would free up the border patrol for more important functions than running down wetback (as that issue would go away).
To the legal aliens in this country. You are most welcome for the diverse culture, experiences, and talents which you bring the the United States.

Plain and simple, the Arizona law in not racially motivated. It enforces existing immigration laws that the federal has failed miserably to enforce. The Obama clan seems to be handling this the same way that they're handling healthcare reform. We will soon become one of the poorest countries in the world due to political incompetence.

CNN should be responsible and not emotional because entering a country illegally is one of the biggest crime. Try this in Iran or North Korea and one should realize that instead of Car, Credit Card, Social welfare, Home, Education what one shall get is severe punishment in jail even without trial. How long has this family been here and the husband has failed to do the proper procedure for getting his wife citizenship? How about you interview a friends of ours who lives in Arizona who has MS and now has to travel over an hour to the nearest hospital because his closed... went bust because of having to provide free health care for illegals? This was such biased reporting! Illegal immigration places a burden on all state services and people who are citizens have to pay for it. These people get more free services than anyone.

SB1070 = Hate ???....If you are illegal then you deserve punishment as you are breaking the law. If you are legal, then you don't have much to worry about...I guess sorry to offend the legal people of the state but if there weren't such a high population of illegal immigrants it wouldn't be required. If CNN wishes to report correctly, why don't you report that a lot of the business are closing down is not because of SB1070, it closed due to the current economy conditions. This family is leaving not because his wife is illegal but because his jewelry business is failing. People do not buy jewelry when they are worried about feeding their children and paying their bills. The hard pressed Arizona businesses are going out of business is due to the recession and NOT because of SB1070. CNN please practice journalism not slanted sensationalism.

Ever since the law 1070 was passed, crime has gone DOWN big time in phoenix and surrounding areas. Talk to any police officer. The police department can't get on national television and say this though.

The sign depicted here and the related video posted by CNN re: an illegal family packing it up and heading back to Mexico in light of the new law are absolutely RIDICULOUS. Enforcing US immigration laws is not HATE-based. There is an immigration process. Follow it, or go home. It really is that simple, people and the general masses of US CITIZENS have had enough of certain people thinking they are above the law and continually breaking that law, no matter their rationale.
I agree with R Kershaw why did she not become a citizen, it is not a hard process. To just up and leave after so many years is not smart. This is the problem these people come here and do want to stay but do not bother to go about the right process.
R Kershaw, I'll attempt to answer your question. It is because there is currently absolutely no process for the people illegally here to become legal. None. Period. Once you are caught illegal and deported, you are banned for 10 years (and maybe forever). If you attemp to leave the country to go back, you can also be apprehended, arrested and processed for deportation, it does not matter that "you were leaving". This is EXACTLY what the Immigration Reform proponents are saying – at least provide some legal means of reviewing these cases, otherwise people are caught in a limbo forever. I hope this answered it.
This good morning report was soooo bias and as usual not correct. How profiling the hospitals that have gone bust because of providing health care for illegal immigrants? How about interviewing people who homes have been robbed.... completely cleared out while they're at work? What about the American dream for tax paying, legal citizens who state economies are in shambles because of providing free education, free health services to illegals who don't pay taxes. If you want to come here... come here legally. Every other country in the world enforces its immigration policies to protect it's people.... yet we're considered horrible because we want to do the same. ok i don't know what every one is trying to say with the big terms like undocumented hay dosent that mean illegal? these things really get me i know people have thier problems but come on the person sitting right next to me, it took him aprox 5 years to get his wife here in the united states legally. and he along with the rest of us defend your freedom. we are supposed to feel for this person who the news decided to explode that is right explode. because she is woried about getting caught for doing something illegal, that she has been doing all along. sometimes i feel like me risking my life serving in the military and leaving my family for extended periods of time is not worth it when you have people like this in my country.

I'm getting tired of the simplistic, "racial profiling, " slogan being applied as the only thing opponents of the bill are arguing. Racial profiling is only the beginning. My biggest problem with SB1070 is that it would require naturalized CITIZENS to carry their documents with them to aviod detention/deportation. No American Citizen should ever be required to carry their "papers" with them.

First, the new law is working and it shows you don't have to deport people; They will leave on their own. Second, I believe they said in the piece that they were not going back to Mexico but rather to another state. That shows we need a national policy like this.

How do I teach about the rule of law to my daughter, when she can look around her and realize 11 million people have broken the law by entering this country illegally?
While she attempted to depict the human interest in this story, she failed to depict why the mother was illegal to begin with? Obviously, the family lacked the basic common sense to follow the law to build their dream, and how can that be a model that will teach their kids and grandkids, to live within the law?
To depict in the video, the sponsor of the law in the light of being a "hardnose" with no positive context around the plight of Arizona, or the rest of our communities around the US who deal with the day laborers littering the street, resorting to alchoholism, and having babies with no way to pay for them, and to depict "fleeing" and crying families complaining that their American Dream is ruined is just absurd reporting.
My American Dream has been to excell within the structure of our society and culture, and within the laws which protect everyone's rights. It has been to raise a family who follow the law and excell, and avoid ever becoming a ward of the State for illegal activity.
When immigrants, especially the nice ones who want a better life, enter the US illegally, they don't respect the law which builds one of the three pilars of our society; rule of law, separation of power, and inalienable rights. The three make up the American package which creates the "land of opportunity".

The Federal court needs to keep its nose out of the state business. Arizona finally got a plan that workes to hell with the illegals tell them to go home and fix their own country or enter the U.S. legally. It was someone from the NAACP who leaked those edited tapes, and yet you refuse to ask the question who and what their motive might have been, ans why the full version was released immediatly after the contoversy began. That would involve some honesty and integrity.

While watching American Morning this morning I saw a report labeled Fleeing Arizona. I like to correct a statement made by the driver of the car that was showing your reporter around. The driver pointed out a closed car dealership. That car dealership is not closed it relocated from Mesa to Chandler along the 202 in to a new autoplex. The car dealerships are leaving stand alone locations and moving to autoplexes this is not just an occurence in Arizona but across the nation.
The impression this piece gave was that it was wrong to take away the "American dream" from this family because of this law.
The American dream also includes truth and justice. Where is the truth and justice compared to illegals?
Why is wanting to make all people follow the law wrong? Why is it racist?
The American dream came from hard working honest people who went by the laws.
If this family wants justice, then they need to go back to what ever country the wife came from. Then here return legally.

I think I know why. After dealing in my job with many inmigrants I found out that many still keep their wives, "barefoot and pregnant". You have not idea as to the times that I asked the same question to many of these men.
They never find it necessary to do so.
