Deadline looms to respond to stay in same-sex marriage ban ruling
(CNN) – Defendants and plaintiffs have until Friday to submit responses to a temporary stay that a California judge granted after striking down the state's ban on same-sex marriage.
Chief U.S. District Judge Vaughn Walker in San Francisco ruled on Wednesday that California's Proposition 8 violates the U.S. Constitution.
He however granted a temporary stay, which stops his decision from taking immediate effect.
Supporters of Proposition 8 argued, prior to Walker's ruling, that same-sex marriages would be performed soon after his decision and could be complicated by rulings and appeals farther down the legal road.
The judge's decision striking down the ban handed supporters of gay rights a major victory in a case that both sides say is sure to wind up before the U.S. Supreme Court.
The 136-page opinion is an initial step in what will likely be a lengthy fight over the proposition, which defines marriage as a union between a man and a woman.
At stake in the trial was whether California's ban on same-sex marriage violates gay couples' rights to equal protection and due process, as protected by the U.S. Constitution. Read more

I don’t think the government should recognize Gay or Straight marriages. Marriage is a religious institution and the 1st Amendment prohibits the government’s involvement in establishments of religion . If two or more people wish to have “next of kin” rights and share their property the government should provide a legal process for doing that. If people want to have children they should check with Immigration and Naturalization they are bringing a new person into the country.
guys i just saw that bit on the ape you guys did . don't be so naive . listen to them emphasize the word( pour) ,(TV). please guys, you can teach these things to birds.
@Scott Carter, regarding your 'civil union' concept. I like that. Think about this. A 'civil union' does not necessarily have to dictate sexual behaviors. It simply means 'friends for life' and that these friends agree to look out for each other and care for each other best interest. To me, a heterosexual, sexual behavior is personal, that is it none of anybodies business except between my 'mate' and myself. And no one has any business dictating what we do or don't do in the privacy of our own home.
What about those who do not believe in organized religion, God or the Bible?
It is not fair to say your beliefs should control their Constitutional rights. Religion should not be an issue when it comes to the laws of this country.
Separation of Church and State has it's purpose and this is a CLEAR example of why it is so important.

We were founded as a nation on the principal of the separation of church and state and this is the reason we lasted so long as a democracy. we set up a court system to protect the minority form the tyranny of the majority. This is what is happening in California where.the majority is religiously grounded and is citing the bible as the basis for denying rights to a group which is contrary to the spirit and language of the constitution. I'm amazed at the hypocrisy of the conservatives who on one hand want government out of their lives and on the other want it to intervene to suppress rights of a group they don't like. This is what happened in the south where the bible was used as a justification to enslave Afro-Americans, and have the majority of whites enforce it. I'm shocked that every so called libertarian isn't against prop 8. If we are going to have government out of our personal lives that means for everybody.

There is no legal presidence for this ruling. This judge is trying to legislate. Marriage by its legal definition in even old English law was created as protection for children and women! thus , a gender specfic contract. nothing more or less. I do understand that there are civil unions for same sex couples so what is really being foughrt here a claiming of a term. So what is being looked at here and does the court have the time to deal with this frivolous issue as to who has righjt to use the word marriage just because...some people want a head trip?
By definition marriage is between man and woman because the one thing same sex couples can't do is procreate by exchanging their genes! Hence, the unique aspect of the contract.

A black woman went to jail for apparently lying about doping in sports while Lance Armstrong even with so many stories to say he used Performance enhancing drugs continue to be the darling of not only of two announcers on CNN amfix ,because he is white but also those who continue to deny that racism exist even on CNN.
It doesn't matter what any religion says what about marriage. The fact is that our Constitution says that the govt can't deny one group the rights that another group enjoys
