Kagan to be Supreme Court nominee, source says

(CNN) – President Obama is on Monday expected to name Solicitor General Elena Kagan as his nominee to replace retiring Justice John Paul Stevens on the Supreme Court, two sources close to the process said.

The announcement at the White House is expected around mid-morning

Kagan, 50, a New York native, was widely reported to be the front-runner for the nomination. She was a finalist for the high court vacancy last year when Justice Sonia Sotomayor was selected to replace the retiring David Souter.

If confirmed, Kagan would be the third woman on the nine-justice bench and the fourth in the history of the court.

Kagan received her law degree from Harvard University, where she later served as dean of the law school. She previously served in the Clinton administration as associate White House counsel. Read more

Should accused 'citizen terrorists' lose their rights as citizens?

(CNN) – A new bill is going after the citizenship of accused terrorists. It would allow the State Department to take it away from people like the suspected Times Square bomber and others who try to attack the United States.

A bipartisan group of legislators on Thursday introduced the legislation in Congress to strip citizenship from any American found to be involved in terrorism.

If the Terrorist Expatriation Act passes, an American would lose citizenship if found to have provided material support or resources to a foreign terrorist organization - as designated by the secretary of state - or participated in actions against the United States.

Sens. Joe Lieberman, I-Connecticut, and Scott Brown, R-Massachusetts, co-sponsored the bill. An identical bill is being introduced in the House by Reps. Jason Altmire, D-Pennsylvania, and Charlie Dent, R-Pennsylvania.

The sponsors of the bill say it's a tool we need to fight a new war. Our Jim Acosta has the report this morning.

(CNN) – Faisal Shahzad made a practice run in Manhattan the day before he allegedly tried to blow up a car bomb in Times Square, according to a law enforcement source with knowledge of his questioning.

Last Friday, Shahzad drove his white Isuzu from Connecticut through Times Square, where he staked out potential locations for the following night's planned attack, the source said. He then parked the Isuzu several blocks away from Times Square, though the precise location was unclear, and took a train back to Connecticut, the source said.

Separately, authorities in Pakistan have rounded up a number of people for questioning, as U.S. law enforcement officials sought Wednesday to piece together Shahzad's actions and motivations.

Iftikhar Mian, the father-in-law of the suspect, and Tauseef Ahmed, Shahzad's friend, were picked up in Karachi, Pakistan, on Tuesday, two intelligence officials said. Read more

Should athletes play politics? Ariz. immigration debate hits MLB & NBA

The world of politics is colliding with the world of sports over Arizona's controversial new immigration law. Last night, there were more protests at the Arizona Diamondbacks' game and the Phoenix Suns took to the court wearing jerseys reading "Los Suns," showing team solidarity with Latinos.

Politicians like former New Mexico Governor Bill Richardson are debating the law, not just here on CNN, but also on ESPN. And both the controversy and the overlap with sports came up during President Obama's remarks about Cinco de Mayo.

Questions surface over Times Square investigation

(CNN) – Questions remained in the days following the dramatic arrest of the Times Square bombing suspect, who was captured only minutes before his plane was due to take off for Dubai in the United Arab Emirates.

Faisal Shahzad was able to board Emirates Flight 202 late Monday despite being put on a no-fly list earlier in the day, but at the time of his ticket purchase, the airline had not refreshed its information so his name did not raise any red flags, a senior counterterrorism official said.

Authorities had tailed Shahzad throughout the day, but lost him before he arrived at New York's John F. Kennedy International Airport, where he was ultimately arrested, the official said.

However, an FBI official responded that surveillance operations are designed with redundancies in place, and that agents had to avoid tipping off Shahzad that he was being followed. Read more

BREAKING NEWS: Times Square bomb suspect arrested trying to board flight

(CNN) – A U.S. citizen has been arrested in the Times Square bombing probe, U.S. Attorney General Eric Holder announced early Tuesday.

Faisal Shahzad, 30, was arrested at JFK airport in New York late Monday as he prepared to board a flight to Dubai, United Arab Emirates, Holder said. However, a law enforcement source with knowledge of the investigation said Shahzad had already boarded the Dubai-bound flight before being arrested and was being questioned overnight.

"It is clear the intent behind this terrorist act was to kill Americans," Holder said. "We will not rest until we bring everyone responsible to justice."

Shahzad will appear in Manhattan federal court Tuesday to face formal charges, the U.S. Attorney's Office for the Southern District of New York said.

Law enforcement officials said the suspect is the person who bought the Nissan Pathfinder used in the bombing attempt. Read more

Police scour video, evidence in Times Square bomb try

Law enforcement officials early Monday pored through evidence, including a 20-second video, after a failed car bombing attempt in Times Square over the weekend.

The video released by authorities showed an image of a man, who police say is possibly connected to the attempted bombing, changing his shirt along a New York street. A balding man with dark hair is seen removing a shirt and putting it in a bag before walking out of the camera's view from inside a restaurant.

The investigation was focusing on examinations of a Nissan Pathfinder where the attempted homemade bomb was placed. New York Police Commissioner Ray Kelly said Sunday that the vehicle was being combed for fingerprints, hair, fibers and other evidence that may help identify who was responsible. Read more

Oil slick awaits NOLA's new mayor

The first white mayor of New Orleans in more than 30 years steps into his first challenge as soon as he takes office Monday: the massive oil slick that is creeping to his coast.

The fallout from a ruptured undersea well off Louisiana is spewing about 210,000 gallons (5,000 barrels) of crude a day into the Gulf of Mexico. And efforts to corral the rapidly growing oil spill have so far been unsuccessful. Read more
